Terms of Service

These Terms of Service (the "Terms") govern access to and use of Discap ("Discap," "we," "our," or "us"), a Discord bot that records, transcribes, and summarizes voice conversations, together with the website at discap.bot and any related features, tools, and services (collectively, the "Service"). By adding Discap to a Discord server, interacting with the bot, or using the website, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
If you add Discap to a Discord server or configure it on behalf of a server, community, company, or other organization, you represent that you have the authority to bind that organization to these Terms, and "you" includes that organization.
The service
Discap provides voice-meeting tooling for Discord servers. Depending on configuration and the current state of the product, the Service includes:
- Recording functionality in Discord voice channels, announced in the channel when recording begins
- Per-speaker capture and automatic, speaker-labeled transcription of recorded audio
- AI-generated meeting summaries, including decisions, action items, and open questions, posted to a configured server channel
- Meeting memory features that answer questions about past recorded meetings
- Storage of audio and transcript artifacts to enable playback, download, reconstruction, and re-processing of meetings
- Administrative commands for configuring, starting, stopping, and reviewing recordings
Early access. The Service is offered in an early-access (alpha) phase and is under active development. The exact feature set, commands, limits, retention behavior, output formats, and other characteristics of the Service are expected to change, sometimes without prior notice. Descriptions on the website reflect the current state of the product and are not a commitment that any feature will remain available or behave the same way in the future.
The Discord platform
Discap operates entirely through Discord. Your use of Discord is governed by Discord's own terms and policies, and you must comply with them when using the Service. Discord account status, server permissions, voice infrastructure, API behavior, rate limits, and platform changes are outside our control and can affect or interrupt the Service at any time. We recommend limiting the bot's permissions to the channels and roles that need it.
Eligibility
You must meet Discord's minimum age requirement (13, or the higher minimum age that applies in your country) to use the Service. By using the Service you represent that you meet this requirement.
Recording consent and lawful use
Discap announces recording in the voice channel when it joins, and individual participants can exclude themselves with the /optout command. These product behaviors do not replace your own legal obligations.
Laws on recording conversations vary by country, state, and context, and may require notice to or consent from every participant. Server owners and administrators who install, configure, or activate Discap are solely responsible for (a) deciding whether recording is appropriate and lawful for their server, (b) providing any notice and obtaining any consent required by applicable law, and (c) the manner in which recordings, transcripts, and summaries are used and shared. Recording conversations without required consent may be illegal in your jurisdiction. We assume no responsibility for any failure to provide required notice or obtain required consent.
Do not use the Service for covert recording or surveillance of any kind.
Acceptable use
You agree to use the Service in compliance with all applicable laws and regulations, and you may not use the Service to:
- Record conversations without any legally required notice or consent
- Harass, abuse, stalk, threaten, or harm others, or invade another person's privacy
- Infringe the intellectual-property, publicity, or other rights of others, or process content you do not have the right to process
- Violate Discord's terms or platform policies
- Distribute malware or other harmful code, or attempt to gain unauthorized access to our systems, other servers' data, or other users' data
- Probe, overload, disrupt, or impair the Service or the infrastructure it runs on, or circumvent rate limits, usage limits, or security measures
- Reverse engineer, decompile, or attempt to extract the source code, models, or non-public data of the Service, except where such restriction is prohibited by law
- Use automated systems to extract data from the Service without our express permission
- Resell, sublicense, or offer the Service to third parties as a service bureau without our prior written agreement
We may investigate suspected violations and may throttle, suspend, or terminate access as described below.
Your content and license
As between you and us, you (and the participants in your meetings) retain all rights you hold in the audio, transcripts, summaries, and other content recorded or generated through the Service at your direction ("Your Content"). We claim no ownership of Your Content.
So that we can run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, process, adapt (for example, transcoding, formatting, and excerpting), analyze, and display Your Content for the purposes of operating, providing, securing, maintaining, developing, and improving the Service, and as otherwise described in our Privacy Policy. This license lasts for as long as Your Content is retained under the retention practices described in the Privacy Policy and survives only as needed for legal compliance, security, and backup integrity.
If you send us feedback, ideas, or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free right to use them without restriction or obligation to you.
The Service itself — including its software, design, branding, website content, and documentation — is owned by us or our licensors and is protected by intellectual-property laws. These Terms grant you no rights in the Service other than the limited right to use it as described here.
Output accuracy
Transcripts, summaries, decisions, action items, answers, and other outputs are generated automatically, including by machine-learning systems, and may contain errors, omissions, mistranscriptions, misattributed speech, or statements that were never made. Outputs are provided for convenience only. You are responsible for reviewing outputs before relying on them, and you must not rely on them as the sole basis for operational, legal, medical, financial, employment, academic, or safety decisions.
Pricing and plans
The Service is currently offered free of charge during the alpha phase. We may introduce paid plans, usage-based limits, feature tiers, or other commercial terms in the future, and we may change pricing and plan structures over time. Material pricing changes affecting existing paid subscriptions will be communicated with reasonable notice. The website describes current public pricing and limits. Where paid plans exist, applicable taxes may be added as required by law.
Service availability and changes
We are constantly developing the Service, and we reserve the right to:
- Modify, add, remove, suspend, or discontinue the Service or any feature, in whole or in part, at any time, with or without notice
- Impose or change limits on usage, retention, storage, or access to parts of the Service
- Perform maintenance that temporarily interrupts the Service
The Service is provided without any service-level commitment during the alpha phase. To the extent permitted by law, we are not liable for any modification, suspension, or discontinuation of the Service or any feature, or for any resulting loss of data or functionality, although the data-handling commitments in the Privacy Policy continue to apply to data we hold.
Data
Our collection, use, retention, and sharing of information — including voice recordings, transcripts, and summaries — is described in the Privacy Policy, which forms part of these Terms. Server administrators control which Discord channels the bot can join and who can access the channels where transcripts and summaries are posted; access to Your Content within Discord is governed by your server's own permission setup.
Third-party dependencies
The Service depends on third-party platforms and providers, including Discord, speech-to-text providers, AI providers, and cloud hosting and storage providers. We do not control these services and make no guarantees regarding their continued availability, pricing, performance, or practices. Changes to, or the unavailability of, any third-party service may impair or completely disable the Service, in some cases with no prior notice, and we are not responsible for issues arising from third-party services.
Termination
You may stop using the Service at any time by removing the bot from your server. We may suspend or terminate your or your server's access to the Service at any time, with or without notice, including for violation of these Terms, suspected abuse, legal or security reasons, or at our reasonable discretion, particularly during the alpha phase. Upon termination, the sections of these Terms that by their nature should survive — including provisions on Your Content licenses needed to wind down processing, output accuracy, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Disclaimer of warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT OUTPUTS WILL BE ACCURATE OR RELIABLE, OR THAT DEFECTS WILL BE CORRECTED.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY OR FIFTY (50) US DOLLARS.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, and nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights.
Indemnification
You agree to defend, indemnify, and hold harmless Discap and its operators, affiliates, and agents from and against any claims, demands, damages, and expenses (including reasonable legal fees) made by any third party arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or of any rights of another person, including recording without required notice or consent; or (d) Your Content.
Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the jurisdiction in which the Discap operator is established, without regard to conflict-of-laws rules. If you are a consumer in the European Union or another jurisdiction with mandatory consumer-protection law, you additionally retain the protections afforded to you by the mandatory provisions of the law of your country of residence.
Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on this subject.
Changes to these terms
We may update these Terms from time to time as the Service develops. When we make material changes, we will update the "Last updated" date above and take reasonable steps to bring the change to users' attention, such as a notice on the website or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
